Terms of use

The rules governing access to and use of the site.

01Purpose and acceptance

These terms of use (the "Terms") set out the conditions under which CaptureValue.ai EOOD ("CaptureValue.ai", "we", "us") makes the website capturevalue.ai (the "Site") available to users, and the rules governing its use.

Accessing and browsing the Site constitutes full acceptance of these Terms, together with the legal notice, the privacy policy and the cookie policy, which form an integral part of them. If you do not accept these conditions, please do not use the Site.

02Definitions

  • "Site": the website available at capturevalue.ai and all of its pages.
  • "User": any natural or legal person accessing the Site, in whatever capacity.
  • "Services": the consulting services and software solutions presented on the Site, in particular Commodum and SetRecord.
  • "Content": all texts, images, diagrams, data, logos, trade marks and other elements published on the Site.

03Access to the site

The Site is available free of charge to any User with Internet access. Access and equipment costs are borne by the User.

CaptureValue.ai endeavours to keep the Site available at all times, without being obliged to do so. Access may be suspended or restricted, without notice, for maintenance, updates, security or any other technical reason, without CaptureValue.ai incurring any liability.

CaptureValue.ai reserves the right to change the content and features of the Site at any time without notice.

04Presentation of the services

The Site is intended to inform and present the Services of CaptureValue.ai. The descriptions, examples, figures and dashboards shown are provided for illustration and constitute neither a contractual offer nor a guarantee of results.

Every engagement is governed by a separate agreement (commercial proposal, services agreement, data processing agreement where applicable), which alone determines the mutual commitments of the parties. In the event of a conflict between these Terms and such an agreement, the agreement prevails.

05Intellectual property

The Site and its Content are protected by intellectual property law and are the exclusive property of CaptureValue.ai or its partners. The names CaptureValue.ai, Commodum and SetRecord, together with the associated logos and distinctive signs, may not be used without prior written consent.

The User is granted a private, non-exclusive and non-transferable right to use the Content, limited to viewing the Site. Any other use — reproduction, representation, extraction, adaptation, distribution, commercial exploitation — is prohibited without the prior written consent of CaptureValue.ai. 06Use of the site

The User undertakes to use the Site in accordance with its intended purpose, these Terms and applicable law. In particular, the User must not:

  • access or attempt to access the Site, its servers or connected systems without authorisation;
  • hinder or disrupt the operation of the Site, in particular by sending large volumes of requests or introducing malicious software;
  • systematically extract, collect or index the Content ("scraping"), including for the purpose of training artificial intelligence models, without prior written consent;
  • use the Site or its Content for unlawful, fraudulent or defamatory purposes or in a way that infringes the rights of third parties;
  • impersonate a third party or provide inaccurate information when getting in touch.

CaptureValue.ai reserves the right to take any appropriate action in the event of a breach, including restricting access to the Site and bringing legal proceedings.

07Getting in touch and booking a call

The Site allows the User to request a conversation or a meeting with CaptureValue.ai. The User undertakes to provide accurate, up-to-date information concerning themselves or the organisation they legitimately represent.

A contact or meeting request does not constitute the conclusion of a contract. CaptureValue.ai reserves the right not to follow up on a request, in particular where it is unrelated to its Services or manifestly abusive.

The data provided on that occasion is processed as described in the privacy policy.

09Liability and warranties

The Site is provided "as is". CaptureValue.ai uses reasonable means to ensure the accuracy of the Content and the security of the Site, without warranting that they are free of errors, interruptions or vulnerabilities.

To the extent permitted by law, CaptureValue.ai cannot be held liable for any direct or indirect damage resulting from the use of the Site, the inability to access it, reliance on the Content or the presence of malicious software on the networks, except in the event of gross negligence or wilful misconduct on its part.

The User is solely responsible for protecting their equipment and data, in particular by using up-to-date security software.

10Personal data and cookies

The processing of personal data carried out through the Site is described in the privacy policy. The use of cookies and trackers is described in the cookie policy; the User can manage their preferences at any time via the "Manage cookies" link in the footer.

11Changes to the Terms

CaptureValue.ai may amend these Terms at any time. The applicable version is the one online at the time the Site is consulted; the date of the last update appears at the top of this page. Users are invited to review the Terms regularly.

12Governing law and jurisdiction

These Terms are governed by Bulgarian law. In the event of a dispute concerning their interpretation or performance, the parties will endeavour to reach an amicable solution. Failing that, the dispute will be brought before the competent courts of Sofia (Bulgaria), subject to the mandatory rules on jurisdiction and consumer protection applicable in the consumer's country of residence.
